China's gallium and germanium export-control campaign (2023-present)
China's gallium and germanium export-control campaign began with a global licensing regime for specified items in August 2023 and escalated to a United States-specific presumption of denial in December 2024. China suspended that country-specific provision from 9 November 2025 to 27 November 2026 while retaining the underlying dual-use licensing system. The controls are direct state action. Their retaliatory purpose in the semiconductor dispute is strongly suggested by timing and target selection but is not the stated legal objective.
Context
Gallium and germanium are distinct by-product commodities used in compound semiconductors, defence electronics, fibre optics, infrared systems and solar applications. China's position differs by metal and supply-chain stage. Production share, export share and United States import reliance therefore require separate series, years and denominators.
By-product economics slow supply response. Gallium is commonly recovered through alumina processing, while germanium comes from zinc and some coal-related sources. Recycling, substitution, stockpiling and alternative refining can mitigate exposure, but purity, qualification and capacity limit the speed of adjustment.
Legal phases
MOFCOM and the General Administration of Customs jointly issued Announcement No. 23 on 3 July 2023, effective 1 August 2023. It required licences for listed gallium and germanium items. Later administrative replacement of that instrument through China's unified dual-use control list did not end the underlying licensing requirement.
Announcement No. 46 of 3 December 2024 prohibited exports of dual-use items to United States military users or military end uses. Its second paragraph stated that specified gallium, germanium, antimony and superhard-material exports to the United States were in principle not to be licensed, while graphite received stricter end-user and end-use review. Announcement No. 72 suspended paragraph two from 9 November 2025 until 27 November 2026. It did not suspend the military restriction or the general licensing regime.
The legal acts state national security, national interests and non-proliferation objectives. The one-day sequence after the United States tightened semiconductor controls supports an inference of retaliation. It does not convert that inference into a declared objective or prove compellence.
Outcome
Recorded direct trade and prices changed after the controls, while buyers and governments increased attention to inventories, recycling and alternative supply. These small, opaque markets require grade, unit, currency, market and observation date for every price claim. Third-country routing and stockpiling are plausible mitigation channels, but their scale requires customs or firm evidence.
No economy-wide production shutdown attributable solely to gallium and germanium has been verified in the audited evidence. That is not proof that no facility was affected. Licensing delay, denial, price change, direct imports, inventories and downstream production are separate outcomes.
Assessment
The controls demonstrated and retained discretionary traceability and denial power. Their realised denial, bargaining and compellent effects remain uncertain, and diversification may erode leverage over time. Scenario-model estimates of potential economic loss are not realised effects.
The record remains in the main sequence because current law gives Chinese authorities direct control over defined export nodes. It remains on current-event watch because Announcement No. 72 is scheduled to expire after 27 November 2026 unless policy changes.
