Nuclear Suppliers Group

The Nuclear Suppliers Group is a non-treaty arrangement of 48 Participating Governments coordinating guidelines for nuclear and nuclear-related exports. The group operates by consensus. Its guidelines are implemented through national law and licensing, not by a supranational NSG enforcement authority.

Structure and legal status

The NSG emerged after India's 1974 nuclear test and developed two guideline sets. Part 1 covers items especially designed or prepared for nuclear use. Part 2 addresses nuclear-related Dual-use goods control. The International Atomic Energy Agency publishes the guidelines as INFCIRC/254, but the NSG is not an IAEA body and the IAEA does not issue NSG export licences.

The group's own terminology is Participating Government, not treaty member or Member State. Current participation is 48 governments. Consensus and national implementation can support coordination while also limiting speed and uniformity. The arrangement belongs beside the Wassenaar Arrangement, Export control as strategic instrument and national obligations associated with UNSCR 1540 (2004), but each has a different legal basis.

In September 2008, participating governments agreed a statement permitting civil nuclear cooperation with India under specified conditions. India is not an NSG Participating Government at the 30 July 2026 lock. The exception and later participation debate are politically contested. They should not be described as Indian membership or as repeal of the guidelines. Denial notifications and national licensing decisions also remain governmental acts, not binding judgments issued by the group itself.

The current control lists require publication-day review. A change circulated through the IAEA does not itself amend national law, and implementation can differ across participating governments.
