Indonesia nickel export ban and downstreaming (2014-2020)
The Indonesia nickel export ban and downstreaming (2014-2020) was Indonesia's prohibition of raw nickel ore exports, first imposed in January 2014 under the 2009 Mining Law, relaxed in 2017 and reimposed in full from 1 January 2020. The declared objective was domestic processing and greater value capture. The programme is a leading case of an ore exporter using market access to induce downstream investment.
Campaign
Law No. 4 of 2009 mandated domestic mineral processing. A 2017 relaxation permitted limited low-grade exports tied to smelter construction before the government brought the full ban forward to 1 January 2020. Indonesian and foreign firms, including Chinese investors, built integrated smelting and stainless-steel capacity at sites including Morowali and Weda Bay. The European Union challenged the measures at the World Trade Organization. The DS592 panel found the export ban and domestic processing requirement inconsistent with GATT Article XI. Indonesia notified an appeal on 8 December 2022. With the Appellate Body non-operational, subsequent appellate deadlines remained suspended on the WTO case page as at 30 July 2026.
Outcome and assessment
The industrial outcome was dramatic: Indonesia rose to produce roughly half of the world's mined nickel by the mid-2020s, and government figures claim downstream nickel-related exports grew from around USD 3 billion before the ban to more than USD 30 billion by 2022, a claim treated here as an official estimate. The contested ledger is threefold: much of the captured value accrues to Chinese-owned processors, making the case as much a story of Chinese supply-chain consolidation as Indonesian development; the environmental and social costs of the smelting boom are severe; and the flood of Indonesian supply crashed nickel prices, disciplining rival producers. As statecraft, however, the case is widely read as the strongest modern demonstration that export denial can restructure a global value chain in the denier's favour.
