Entity List (15 CFR Part 744)

The Entity List is an export-control list maintained by the United States Department of Commerce's Bureau of Industry and Security under Supplement No. 4 to Part 744 of the Export Administration Regulations. A listing imposes specified licence requirements and review policies on exports, re-exports and transfers involving the named entity or address. It does not itself freeze assets.

Legal operation

The live Entity List must be read with the relevant entry, the Commerce Control List, end-use rules and the scope provisions of the EAR. Each listing identifies affected items and licence policy. Foreign-produced items may be covered where an applicable foreign direct product rule or de minimis rule brings them within the EAR. Use of United States technology does not make every foreign product subject to United States controls.

The End-User Review Committee, chaired by Commerce and including the state, defence, energy and treasury departments, decides additions and removals under procedures in Supplement No. 5. Additions generally require majority agreement; removal or modification generally requires consensus. Listed parties may request removal.

Strategic use

The list began in 1997 with a proliferation focus and broadened into a central instrument of technology denial. Huawei was added in May 2019, followed by amendments extending controls to affiliates and specified foreign-produced items. SMIC, supercomputing entities, Russian defence-linked firms and procurement intermediaries have also been listed under distinct legal rationales. Each Federal Register notice must be assessed on its own grounds.

Listing can interrupt access to semiconductors, software, manufacturing equipment and services. Effects depend on product scope, licence practice, stockpiles, substitutes and enforcement. Targets may redesign supply chains or accelerate domestic production. Those responses can weaken immediate capability while also reducing future United States leverage.

Assessment

The Entity List combines a named-party perimeter with the technological reach of the EAR. Its precision is greater than an economy-wide embargo, but affiliate structures and third-country procurement create evasion and enforcement problems. Current status is highly date-sensitive. As at 29 July 2026, users must consult the Consolidated Screening List and Federal Register, not this analytical summary, before acting.

Compliance boundaries

An Entity List match is the beginning of analysis, not the end. Parties must confirm the listed name and address, determine whether the transaction involves a listed person, classify the item and establish whether it is subject to the EAR. Ownership rules used in financial sanctions do not automatically apply to the Entity List, although separately listed affiliates and address-based entries may extend the practical perimeter. Licence exceptions are unavailable where the relevant entry or rule says so. The list also differs from the Military End User List and Unverified List. Combining these regimes without identifying the operative rule can overstate both legal reach and strategic effect. Address entries require especially careful matching.

Address entries can capture multiple businesses at one location without making every nearby person a listed party.
