Denied-persons and unverified lists

Denied-persons and unverified lists are distinct United States export-control tools administered by the Bureau of Industry and Security (BIS). A denial order withdraws or restricts a person's export privileges following the applicable legal process. The Unverified List identifies foreign parties whose bona fides BIS could not verify through an end-use check. Neither list is interchangeable with the Entity List or the Treasury sanctions lists.

Denied-person restrictions depend on the terms of the order and the Export Administration Regulations. They can prohibit the named person from participating in transactions involving items subject to the regulations and can restrict others from facilitating prohibited dealings. The list records operative orders; the legal effect comes from the order and regulations, not the label alone.

Placement on the Unverified List does not itself impose the Entity List's licence requirement. It suspends eligibility for specified licence exceptions and requires a statement from the listed party for transactions subject to the regulations. Exporters also assume additional recordkeeping and due-diligence obligations. BIS may remove a party after a satisfactory end-use check or move it to another list through separate action.

The strategic mechanism is graduated denial. Verification friction raises the cost of dealing with an uncertain end user, while a denial order excludes a person from controlled trade. This can protect technology and encourage compliance without treating every unresolved verification as established misconduct.
