Deemed-export controls

A deemed export is the release or transfer in the United States of controlled technology or source code to a foreign person. Under EAR section 734.13, that release is treated as an export to the person's most recent country of citizenship or permanent residence, subject to the regulation's detailed rules.

The legal question is not whether an employee learns something. It is whether specified technology or source code is released through visual inspection, oral exchange, application under guidance or another controlled means. Publicly available information and other exclusions must be tested under Part 734 before licensing is considered.

Classification comes first. The exporter must identify the technology, ECCN, destination and applicable controls, then test licence requirements, review policy and exceptions under Parts 742 and 744. Section 734.20 addresses certain releases to persons with more than one nationality. An Entity List (15 CFR Part 744) restriction may add a party-specific requirement, but it does not replace classification.

Deemed-export compliance can affect access controls, research assignments and recruitment. It is not itself a statutory ban on employing foreign nationals, and a nationality-based destination test should not be restated as an ethnic restriction. Claims about labour-market or innovation effects require separate evidence.

As at 30 July 2026, analysis should specify the controlled information, person, release, destination rule and licensing provision. Export-control licensing regime, Technology denial and Talent and knowledge-transfer restriction describe related mechanisms, not automatic legal outcomes.

Controls should be implemented at the information boundary. Marked repositories, role-based access, technology-control plans and recorded licence determinations can reduce risk without assuming that every conversation is a release. Publication should distinguish the written control plan from an actual authorised or unauthorised transfer.
