Treasury Office of Investment Security
The Treasury Office of Investment Security (OIS) is the United States Treasury office that administers Treasury's work on inward and outbound investment security. The office appeared as Treasury's named regulatory component in the 2008 revision of 31 CFR part 800. It supports the interagency Committee on Foreign Investment in the United States and administers the Outbound Investment Security Program. These are different legal processes.
Responsibilities
For covered inward investment, OIS manages Treasury's chairing and administrative role in CFIUS. CFIUS is an interagency committee. It reviews specified transactions, can negotiate mitigation and makes recommendations, but presidential authority governs specified prohibition or suspension decisions. The framework in 31 CFR part 800 implements authorities expanded by FIRRMA. Treasury's February 2026 Known Investor programme concerns process and information; it does not convert OIS into the sole transaction decision-maker.
The outbound programme operates under 31 CFR part 850. It requires notifications for certain transactions and prohibits defined transactions involving covered foreign persons and technologies. It is a rule-based regime, not a reverse CFIUS case review. OIS administration, Treasury rulemaking, investor compliance and presidential CFIUS action must therefore be attributed separately.
Investment screening mixes defensive risk reduction with denial of access to capital or technology. Its statecraft character depends on the legal measure and case, not the office name alone. The operative Treasury pages and regulations were checked on 30 July 2026.
Risk mitigation can include conditions on governance, access, technology or information when the committee and parties adopt an agreement. Compliance monitoring is distinct from the initial national-security assessment. For outbound investment, covered United States persons carry notification and prohibition duties under the rule. The office administers these frameworks, while transaction parties remain responsible for accurate filings and compliance.
