Pressler Amendment (US, 1985)

The Pressler Amendment added section 620E(e) to the Foreign Assistance Act in 1985 and is now found at 22 USC 2375(e). It remains in force as amended. The provision conditioned specified assistance to Pakistan on an annual presidential certification concerning possession of a nuclear explosive device and whether proposed assistance would reduce that risk. It used Foreign aid conditionality as Economic statecraft.

Operation and history

The certification requirement applied to a defined statutory relationship, not every form of United States-Pakistan commerce. When President George H. W. Bush could not make the certification in 1990, military assistance and deliveries were cut off. The treatment of paid-for F-16 aircraft became a separate contractual and legislative issue.

The provision must be distinguished from the Symington and Glenn Amendments (US, 1976 and 1977) and the Nuclear Non-Proliferation Act (US, 1978). Each has different triggers, exceptions and waiver architecture. Later appropriations and statutes created Pakistan-specific exceptions or relief. Those changes do not erase the historical 1990 cutoff or turn it into an automatic current blanket embargo.

The broader Sanctions following the Indian and Pakistani nuclear tests (1998-2001) arose under other authorities. As at 30 July 2026, 22 USC 2375 remained amended. Any claim that assistance is currently prohibited must identify the operative appropriation, exception, waiver and programme.

The amendment proves Congress imposed a certification condition. Whether the cutoff delayed proliferation, damaged influence or changed Pakistani policy remains contested. Sequence and aid loss alone do not establish compellence.

Certification failure, assistance suspension and later statutory relief must each carry a date. They are not interchangeable descriptions of one continuous policy.
