Non-Intercourse Act (US, 1809)

The Non-Intercourse Act, enacted on 1 March 1809 at 2 Stat. 528, was an expired United States trade statute. It replaced Jefferson's Embargo Act (1807-1809) by reopening most foreign commerce while maintaining restrictions directed at Britain and France. It used selective market denial as Economic statecraft before being replaced by Macon's Bill No. 2 (US, 1810).

Operation

The Act restricted entry by British and French vessels and imports of goods from their dominions. It also authorised the President to suspend the restrictions for a power that ceased violating United States neutral commerce. Customs administration, presidential proclamation and diplomatic recognition of a change in belligerent policy were separate steps.

The law responded to Britain's British Orders in Council (1807) and Napoleon's Milan Decree (1807). Those foreign measures imposed competing constraints on neutral trade. The United States statute did not itself revoke either system or settle whether a belligerent had complied.

Selective restrictions reduced the domestic burden of the general embargo but created enforcement and routing problems. Goods could move through third jurisdictions, merchants adjusted documentation and the measure exposed the limits of United States leverage. Economic costs, maritime seizures and the road to the War of 1812 had multiple causes. The Act proves a declared coercive design; it does not by itself prove compellence or causal responsibility for war.

The presidential suspension power was conditional, not a free-standing permanent delegation over all foreign trade. Any claimed activation needs the corresponding proclamation and date.

The repaired link to the United States Neutrality Acts (1935-1939) is retained for comparison, but those twentieth-century statutes were a separate legal regime.
