Mexico blocking statute (1996)

Mexico's blocking statute, published on 23 October 1996, is the Ley de Protección al Comercio y la Inversión de Normas Extranjeras que Contravengan el Derecho Internacional. It is an in force defensive measure against specified foreign rules with extraterritorial effects and belongs to the family of Blocking statutes used in Economic statecraft.

Rules and limits

The law restricts acts that would prejudice Mexican trade or investment by complying with designated foreign measures. It also establishes reporting duties and administrative penalties. The official Gazette text and the Chamber of Deputies' current federal-law register are needed to determine the operative wording and responsible authority as at 30 July 2026.

The statute was adopted in the context of the United States Helms-Burton Act (1996). That context does not mean Mexican law nullifies United States law outside Mexico. A blocking rule can prohibit or penalise compliance within its own jurisdiction, create conflicting duties and affect recognition or enforcement questions. It cannot erase the foreign measure as a matter of the foreign state's law.

Mexico's approach resembles the EU Blocking Statute (Regulation 2271/96) and Foreign Extraterritorial Measures Act (Canada, 1985), but their procedures, listed measures, reporting channels and remedies differ. A company facing both a foreign restriction and a Mexican anti-compliance rule must analyse the particular transaction and jurisdiction. The statute's existence proves legislative resistance, not that every company refused compliance or that foreign pressure failed.

Enforcement also requires a competent Mexican authority, an identified duty and the procedure set by domestic law. A private contract response is not automatically a government penalty.
