EDA-software export restriction
EDA-software export restriction is the application of export law to specified electronic-design software, technology, keys, users or end uses. It is not a universal prohibition on all Electronic design automation (EDA) software, all Chinese users or all mature-node chip design.
Legal perimeter
The Export Administration Regulations combine several routes to control. The Commerce Control List assigns ECCNs and technical parameters. ECCN 3D006 covers specified software for developing extreme-ultraviolet masks. Other ECAD or TCAD software can be controlled under different entries or under Part 744 when the exporter has the required knowledge of an advanced-node semiconductor development or production end use.
Entity List entries impose party-specific licence requirements. Foreign Direct Product Rule provisions can reach qualifying foreign-produced items only when their product and party tests are met. Rules concerning software keys can control access even where a copy is already installed. These routes must be analysed separately.
Current setting
The December 2024 semiconductor rule expanded controls affecting specified ECAD and TCAD software and advanced-node activity. As at 30 July 2026, the live CCL, Part 744, relevant entity entry and effective amendments control the result. A press summary or vendor notice cannot replace those provisions.
BIS's 2025 Cadence order concerned admitted unauthorised exports to listed Chinese entities during the settlement period. It establishes the agency's findings and agreed penalty, not that every Cadence customer or every EDA transaction is prohibited. Enforcement posture and current licence policy must be checked at publication.
Strategic effect
EDA links design rules, process-design kits, verification and fabrication. Restricting a qualifying tool, update, key or support service may raise cost or delay advanced design. The effect depends on installed versions, foundry compatibility, domestic alternatives, engineering skill and the exact process node. Semiconductor and lithography equipment denial may reinforce the constraint, but compound effect is an empirical question.
The Chokepoint effect is strongest when a controlled tool is essential, difficult to substitute and tightly linked to foundry qualification. Denial does not necessarily halt all design, and a domestic tool announcement does not prove full substitution. Assessment should identify the tool function, ECCN, end use, party, licence rule, denial period and demonstrated technical consequence.
Compliance sequence
An exporter should first determine whether the software, technology or key is subject to the EAR. It then classifies the item, identifies all transaction parties and tests destination, end-use and end-user provisions. A distributor, cloud environment or remote-support session can introduce a different transfer path from delivery of an installation package.
Documentation should preserve the software version, controlled functions, customer address, beneficial owner, design node, foundry relationship and stated end use. A licence may cover only named users or a specified period. Renewal, maintenance and technical support need their own analysis if the authorisation does not cover them.
Policy evaluation should distinguish applications submitted, licences granted, services withdrawn, keys disabled and projects delayed. These are different measures. Evidence that one firm paid a penalty cannot establish market-wide compliance, while evidence of continued chip design cannot establish that the control imposed no cost or capability delay.
