CJEU Rosneft judgment (2017)

The CJEU's Rosneft judgment, Case C-72/15, addressed judicial review and interpretation of European Union restrictive measures adopted against Russia in 2014. The Court held that it had jurisdiction, on a preliminary reference, to review the validity of specified Common Foreign and Security Policy measures under the treaty exception for restrictive measures against persons. It rejected the validity challenges before it and interpreted provisions governing financial services and oil-sector technology.

Decision and boundary

The reference arose from United Kingdom proceedings concerning Council Decision 2014/512/CFSP, Regulation 833/2014 and national criminal penalties. Rosneft challenged measures restricting access to capital markets and specified services and technology. The Court read Articles 24 TEU and 275 TFEU as allowing validity review of restrictive measures against natural or legal persons through Article 267 TFEU.

The judgment did not create general CJEU jurisdiction over every CFSP act. Its jurisdictional conclusion depended on the treaty provisions and the character of the measures at issue. It also did not hold that every later amendment to the Russia sanctions regime is valid.

Statecraft significance

Rosneft confirms that economic coercion implemented through EU legal acts remains subject to a judicial architecture. CFSP decisions establish political and legal commitments, regulations create directly applicable obligations, member states supply penalties and enforcement, and national courts may refer questions to the CJEU. These roles should not be collapsed into a single sanctions authority.

The Court's rejection of the pleaded challenges supported the 2014 measures on the record and arguments before it. Current Russia measures have changed substantially since 2017 and require the current consolidated instruments.
