BAFA

BAFA, the Federal Office for Economic Affairs and Export Control, is Germany's principal administrative and licensing authority for export controls. It examines transactions under German foreign-trade law and the European Union's dual-use regime. It does not independently set German foreign or security policy, and a BAFA licence does not displace any additional approval required under another statute.

BAFA administers the Foreign Trade and Payments Act and its implementing ordinance within its assigned competence. For dual-use items, Regulation (EU) 2021/821 supplies the Union framework, including controls based on listed items, end use, cyber-surveillance risks and brokering or technical assistance in specified circumstances. The applicable legal basis and decision maker therefore vary with the item, destination and proposed transaction.

The office turns policy and law into transaction-level decisions. Its instruments include individual licences, general authorisations, end-use assessment and public guidance. Control lists and multilateral arrangements inform the system, but they are not interchangeable with the directly applicable European regulation or German law. War-weapons exports engage a separate statutory framework and government responsibilities beyond BAFA's ordinary dual-use administration.

BAFA is strategically significant because German firms supply advanced machinery, chemicals, electronics and industrial equipment across global value chains. Licensing can deny access to sensitive capability while general authorisations preserve lower-risk trade. The same position produces a persistent enforcement problem: a lawful export can later be diverted through a third country. Evidence that a German-origin component reached a prohibited end user does not, by itself, establish that BAFA authorised that end use or that the original exporter breached the law.
